General Terms And Conditions and FAQs for JTV Gift Card Program

Introduction.  JTV® Gift Cards (“Gift Cards” or “Gift Card” in the singular) are issued by America’s Collectibles Network, Inc. dba JTV® (“JTV” or "We" or sometimes referred to as “ACN”).  JTV can delegate its issuer obligations to an assignee, without recourse.  If delegated, the assignee, not JTV will be the sole obligor to the Gift Card owner.

By accepting, purchasing, redeeming or otherwise using a Gift Card, you agree to these Terms and Conditions ("Terms and Conditions"), which include all terms that may accompany your Gift Card, as well as JTV’s General Terms and Conditions and Privacy Policy, all of which collectively constitute an Agreement (“Agreement”) between JTV and you.  You should not purchase, redeem or otherwise use a Gift Card if you object to this Agreement. Redemption or use of the Gift Card constitutes acceptance of this Agreement.  We reserve the right at any time and in our sole discretion, to modify these Terms and Conditions by posting notice of such modifications on this website.  If there is a conflict between these Gift Card Program Terms and Conditions and JTV’s General Terms and Conditions, these Gift Card Terms and Conditions will control.  The FAQs for JTV Gift Card Program (below) are part of these Terms and Conditions.

Please read this Agreement carefully.  It includes a binding arbitration provision, a class action and jury trial waiver, and limitations on liability and damages.

JTV Gift Cards come in two varieties, “Physical Gift Cards” (paper or plastic, although typically plastic and shipped by a common carrier) and “eGiftCards” which are provided by email in the form of an electronic code.  The term “Gift Cards” (or “Gift Card” in the singular) refers to both Physical Gift Cards and eGiftCards, except where specifically indicated otherwise.  Additional Terms and Conditions apply to Gift Cards which are distributed exclusively by CashStar, including CashStar’s Terms and Conditions, Site Terms of Use and Privacy Policy.  JTV may also offer promotional rewards from time to time, under the JTV Brilliant Cash Rewards Program (the “Brilliant Cash Program”).   Offers from the Brilliant Cash Program shall each be separately identified at the time of availability and are subject to the Brilliant Cash Program Terms and Conditions. Let’s begin with a general overview.  Your JTV Gift Card:

• Is redeemable ONLY up to the available balance of your Gift Card. Any purchase amount greater than the available balance of your Gift Card must be paid with an alternative method of payment approved by JTV (for example, through use of a credit card).
• Is redeemable only to purchase JTV merchandise and services offered on JTV’s television broadcast, online at JTV.com or on JTV’s mobile Apps.  Therefore, your Gift Card is not redeemable with other merchants.
• Must be redeemed for purchases by calling 1-800-619-3000 (available 24 hrs/day).
• Is not redeemable for cash, for credit, or on an existing installment account, unless otherwise required by law. See – Goods, Services & Cash below.
• Will NOT be replaced if lost, stolen or used without authorization. Therefore, you will bear the risk of loss with respect to a Gift Card that is lost, stolen or used without authorization.

Payment Methods.
Gift Cards may be paid for with valid credit cards, which include VISA, MasterCard, Discover, and American Express or a valid debit card.  Your transaction to purchase the Gift Cards sold on this website will be directly between you and CashStar.

Shipment.
Physical Gift Cards may be shipped to a physical address or to a U.S. Post Office Box via USPS as a standard method of shipment.  For expedited shipments, UPS may be selected at check out; however, expedited shipments require a physical address for delivery, and they may not be delivered to a Post Office Box.

Fees and Expiration Dates  
JTV Gift Cards never expire, nor do we charge any fees in connection with their use. You will only be charged the face value of the Gift Card purchased; however shipping and handling fees may apply. 

Delivery Information and Requirements for Gift Card Purchasers.   
All orders of Gift Cards are subject to a process that compares purchaser information with information about the purchaser provided by the purchaser's financial institution. If there is a discrepancy, your Gift Card order may be delayed until it can be corrected.

We are not responsible for Gift Cards that are undeliverable or not received due to your failure to provide an accurate physical address or email address for the recipient. Please check to make sure the address of the recipient is correct and contact JTV by calling the JTV call center at 1-800-619-3000 (available 24 hrs/day), or by emailing jtvgiftcards@jtv.com if you suspect the recipient did not receive his/her Gift Card. Please refer to your order number or be ready to supply your email address.  Should an email be returned to us due to inaccurate delivery information for the recipient, we will attempt to contact you for a valid email address. You may also visit www.jtv.com for additional information.

Balance Limit
Your Gift Card is only usable up to its available balance to purchase JTV merchandise and services offered on JTV’s television broadcast, online at JTV.com or viewed on a JTV mobile Apps. Remember that to redeem your Gift Card for your selected merchandise or services, you must call the JTV call center at (800)-619-3000 (available 24 hrs/day) and have your Gift Card information available.  For information on how to make balance inquires, see Balance Inquiries below.

Usable for JTV Goods and Services Only
Remember that your Gift Card is redeemable ONLY to purchase JTV merchandise and services offered on JTV’s television broadcast, online at JTV.com or on the JTV mobile Apps. You cannot use the Gift Card with other merchants. For information on JTV, visit JTV.com.

To avoid any confusion, let us clarify a point about how you’ll use JTV Gift Cards.  Except for the exceptions we cover in these terms and conditions, you can use your Gift Card to purchase anything JTV sells, whether you see it on JTV’s television broadcast or on jtv.com or one of our mobile Apps.   But to redeem your Gift Card on the items you want to buy, you must call the JTV Call Center at (800) 619-3000 (available 24 hrs/day).

Limits on Cash Redemption
Unless otherwise required by law, your Gift Card is not redeemable for cash. A limited number of states have enacted statutes that require gift cards to be redeemable for cash in certain circumstances that are set forth in their statutes. For inquiries or additional information, contact us at 1-800-619-3000 (available 24 hrs/day).

Recurring JTV Payments
JTV’s StretchPay™ Program allows you to pay for our merchandise in installments.  You can use your Gift Card to make the first StretchPay payment (we call this your “deposit”), although we may need to make a small adjustment to that payment to set up your method of payment for future installments. More on this below. You can’t use your Gift Card to make payments on any existing installment plans, such as those you may have for previous StretchPay™ purchases.  Gift Cards also can’t be used to make payments on any credit account, such as a Discover Card or a JTV credit card.

If your Gift Card balance won’t cover your first payment on your Stretch Pay™ purchase (and the difference is more than $1), you may simply apply your Gift Card balance to the first payment, and we’ll charge your method of payment for the remaining amount. For example, if your first payment is $100 and your Gift Card balance is $40, we’ll reduce your Gift Card balance by $40 and charge your method of payment for what’s left over ($60).

If your Gift Card balance is larger than the amount of the first payment, we’ll need to add one small step--charging $1 to the method of payment you’ll use for your future payments. This allows us to set up your method of payment and verify that it’s valid for your installment payments. We’ll also need to add this step if you want to use your Gift Card and Brilliant Cash Rewards to make the first payment and the combined balances exceed the amount of that payment.  

Here’s an example of how this will work.  Nadine is purchasing a $500 item on Stretch Pay™.  She’ll have a total of five payments of $100. Nadine has $75 in her Rewards account and a $50 JTV Gift Card.  She wants to use them both for her first payment.  We’ll reduce her Rewards balance by $75.  We’ll then reduce her JTV Gift Card by $24 and charge her VISA card for $1. At that point, Nadine will have made her first StretchPay™ payment, and she’ll still have $26 left on her JTV Gift Card.  Her remaining StretchPay™ installments will be charged to her VISA card.

Purchase of Other Gift Cards; Returns of Gift Cards
You may not use a Gift Card to purchase another Gift Card or to make payments on any credit account, including a credit card balance. Purchases of both eGift Cards and Physical Gift Cards are not refundable and may not be returned once they are purchased.
 
Other Prohibited Uses
Your Gift Card cannot be used in any illegal transaction.

Card Not Present Purchases
Remember that your Gift Card is usable to make "card not present" purchases. As a result, you may use the card to make purchases over the phone.

Reduction of Card Balance
The initial available balance on your Gift Card will be an amount set at the time of activation and/or purchase in any amount from $25-$500. Thereafter, the available balance will be reduced by each authorized use of the Gift Card or as otherwise provided in the Terms and Conditions, except as prohibited by law.

Purchases for Less than the Card Balance
Remember that if you use your Gift Card to make a purchase for less than the available balance of the Gift Card, the remaining balance will not be paid in cash to you, unless a cash payment is otherwise required by law. See Goods, Services & Cash above. You will be able to use the remaining balance on the Gift Card to purchase other JTV merchandise and services by calling 1-800-619-3000 (available 24 hrs/day).

Purchases for More than the Card Balance
Your Gift Card is redeemable ONLY up to the available balance of your Gift Card. Any purchase amount greater than the available balance of your Gift Card must be paid with an alternative method of payment approved by JTV (for example, through use of a credit card).

Purchases using Gift Cards and Brilliant Cash Rewards
You can combine Gift Cards with your Brilliant Cash Rewards to make a purchase from us.

Returns and Exchanges of Purchases made with Gift Cards
Returns of JTV merchandise and services, which are purchased in whole or part with a Gift Card, are subject to our standard return policies and procedures.  For any purchases made only by redeeming a Gift Card, the item’s purchase price will be refunded in the form of a credit to your JTV account. Any charges connected with the return such as shipping or restocking fees (“Return Expenses”) will be deducted before the credit is made to your JTV account. Amounts paid using multiple methods of payment, such as a Visa card and a Gift Card, will be refunded in the same amounts to the original method of payment accordingly, less Return Expenses.  

For example, imagine Betty Lou bought a beautiful chrome diopside and zircon ring set in sterling silver for $89.99, and she snagged an offer with free shipping.  To buy the ring, she used the $50 balance on her plastic Gift Card and put $39.99 on her VISA card.  She later decided to return the ring and incurred a $6.99 shipping charge to return this item.  JTV would issue a $43.01 credit to her JTV account ($50 gift card amount less shipping charge of $6.99). JTV also would credit her VISA card for $39.99.  

Purchases made in whole or part using rewards from the Brilliant Cash Program and returns of those purchases are subject to additional terms under the Brilliant Cash Program

Limits on Gift Card Purchase Amounts
The maximum value that can be associated with any one Gift Card at any given time is $500.00.  The total value of Gift Cards purchased in a single transaction cannot exceed $1,000. No single individual may purchase Gift Cards with a total value of more than $10,000.00 on any one calendar day.  

The minimum Gift Card purchase is twenty-five dollars ($25).

Card Type
Your Gift Card is a limited-value and limited-use card. It is not a credit card, a debit card, asset account, or a deposit account. Your Gift Card is not a bank issued card. The funds loaded on the Gift Card are not segregated or kept in a fund pending use of the card. Therefore, the Gift Card obligation is not backed by segregated cash funds. Gift Cards may be purchased and given as gifts or retained by the purchaser.  

Safeguarding - Lost, Stolen or Damaged Cards
Remember to safeguard your Gift Card. Although it is not a cash equivalent, it contains value and you should safeguard your Gift Card like cash. Your Gift Card will not be replaced if it is lost, stolen or used without authorization. Therefore, you will bear the risk of any Gift Cards that are lost, stolen or used without authorization.  

For physical Gift Cards (paper or plastic), risk of loss passes to the recipient as soon as the Gift Card is delivered to the designated carrier. JTV is not responsible for Gift Cards that are undeliverable or not received due to a purchaser’s failure to provide an accurate physical address or email address for the recipient.

The JTV Brilliant Cash Program
From time to time, and at our sole discretion, JTV may make various promotional offers under the Brilliant Cash Program to allow JTV customers the opportunity to earn rewards by making qualifying purchases of JTV merchandise and services which are offered on JTV’s television broadcast, online at JTV.com or the JTV mobile Apps.  From time to time, and at our sole discretion, JTV may make other types of promotional offers under the Brilliant Cash Program, which may or may not require a purchase.  All promotional offers are subject to certain conditions or limitations, which vary depending on the specific limited offer.  You should carefully review all terms that accompany any promotional offers you may receive as terms may contain expiration dates and other restrictions as well as change or be discontinued without notice.

Other Limitations

• Total purchases of Gift Cards by any one person in any one day (24-hour period) may not exceed ten thousand dollars ($10,000).  Total value added to any single Gift Card may not exceed five hundred dollars ($500).  The total value of Gift Cards purchased in a single transaction cannot exceed $1,000.
• Gift Cards may not be accepted for certain conference registrations and classes.  Please contact our Call Center at 1-800-619-3000 (available 24 hours a day) to determine whether a Gift Card can be used to pay for specific conferences or classes.
• Gift Cards may not be used for purchases at the Gemstore by Jewelry Television, an affiliated store in Knoxville, Tennessee.
• Gift Cards may not be used on JTV Express Ordering System, or other automated system that processes orders by phone.
• Gift Cards are void if resold or transferred for value without authorization.

Dispute Resolution and Arbitration/ Limitations on Liability and Damages

Arbitration Rights / Class Action and Jury Trial Waiver/Time Limit on Claims

Under this Agreement, both you and JTV have given up any rights to litigate claims in a court or before a jury, or to participate in a class action or representative action with respect to a claim, except as set out below.  Other rights that you would have in court may also be unavailable or limited in arbitration.

ARBITRATION.  Any controversy or claim EITHER PARTY MAY HAVE AGAINST THE OTHER, WHETHER PRE-EXISTING, PRESENT OR FUTURE, IN CONTRACT OR TORT OR OTHERWISE, arising out of or relating in any manner to GIFT CARDS, PROMOTIONS, REWARDS PROGRAMS, Products or Services purchased from OR PROVIDED BY JTV (on either the websiteS, the network OR ITS MOBILE APPS) (the “PRODUCTS”), orders placed for THE product(s), return of THE product(s), use of THE product(s), THIS AGREEMENT and/or use of the websites, network OR MOBILE APPS (“Claim”) shall be settled EXCLUSIVELY AND FINALLY  by individual binding arbitration administered by the American Arbitration Association (“AAA”) using the AAA's  rules and procedures applicable to consumer disputes. the aaa’s rules are available at www.adr.org or by calling 1-800-778-7879.  Any decision or award as a result of any such arbitration proceeding shall be in writing and final and shall provide an explanation for all conclusions of law and fact.  THE ARBITRATOR SHALL BE EMPOWERED TO GRANT WHATEVER RELIEF WOULD BE AVAILABLE IN COURT UNDER LAW OR IN EQUITY and shall have exclusive authority to resolve any diSPUTE relating to arbitraBility and/or enforceability of this arbitration provison, including any unconsCionability challenge or any other challenGE that the arbitration provision of this Agreement is void, voidable or otherwise invalid. An award of arbitration may be confirmed in a court of competent jurisdiction in the venue in which the arbitration is conducted.  Such arbitration shall be specific to you. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. JTV will reimburse those fees for claims totaling less than $5,000.00 unless the arbitrator determines your claims are frivolous.

CLASS ACTION WAIVER.  You expressly waive your right to PARTICIPATE IN OR BRING any CLASS action against JTV, either in arbitration or in any court, AS A LEAD PLAINTIFF, CLASS REPRESENTATIVE, CLASS MEMBER, OR PRIVATE ATTORNEY GENERAL OR AS PART OF A CONSOLIDATED ACTION.  

CERTAIN SMALL CLAIMS. for claims that DO NOT EXCEED $5,000 and do not involve a request for an injunction or other equitable relief, both parties retain the right to seek adjudication in a COURT IN the county of your residence. You waive any right to consolidate or otherwise combine your Claim with any Claim(s) filed by other persons.

INTELLECTUAL PROPERTY DISPUTES.  notwithstanding language in this agreement to the contrary, either YOU OR JTV MAY FILE SUIT IN COURT TO ASSERT INFRINGEMENT OR OTHER MISUSE OF INTELLECTUAL PROPERTY.

EXCLUSIVE VENUE AND JURY TRIAL WAIVER.  In the event the foregoing AGREEMENT TO ARBITRATE is held to be unenforceable by any court OR ARBITRATOR, you and JTV agree to submit to the exclusive jurisdiction of the courts located in Knox County, Tennessee to resolve any Claim. you also agree to the exclusive jurisdiction of such courts for intellectual property disputes. IN EITHER SITUATION, WE BOTH AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL.

TIME LIMIT ON CLAIMS. EXCEPT FOR claims concerning INTELLECTUAL PROPERTY and INDEMNITY, ANY CLAIM THAT THE PARTIES HAVE AGAINST EACH OTHER must be commenced within one year after the Claim or cause of action arises or such Claim or cause of action shall be barred. (“claim” is DEFINED IN THE ABOVE SECTION ADDRESSING ARBITRATION.) IN claims INVOLVING AMOUNTS YOU OWE FOR PURCHASES UNDER JTV’S STRETCH PAY PROGRAM, THE ONE YEAR PERIOD for initiating claims WILL BEGIN WHEN THE FINAL INSTALLMENT FOR SUCH PURCHASE IS OR WOULD HAVE Become due.

Limitations of Liability and Damages
WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE GIFT CARDS, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. RECOVERY OF DAMAGES SHALL BE LIMITED TO ACTUAL AND DIRECT DAMAGES, AND MAY NOT INCLUDE ANY INDIRECT, SPECIAL, CONSEQUENTIAL, ENHANCED, OR PUNITIVE DAMAGES.  YOU HEREBY AGREE TO WAIVE THE RIGHT TO SEEK OR RECOVER ANY INDIRECT, SPECIAL, CONSEQUENTIAL, ENHANCED, OR PUNITIVE DAMAGES.

Note: In some states, the law does not permit limitations on implied warranties or the limitation or exclusion of certain types of damages. If those laws are applicable to you, some or all of the foregoing limitations and waivers may not apply to you. In that event, the limitations and waivers shall be applicable to the fullest extent permitted by law.

Extension to Related Entities / Persons and Survival
The foregoing arbitration provision, limitations, and waivers are intended to be construed broadly, and shall apply to any and all claims arising out of or relating to your purchase, acceptance or otherwise use of the Gift Cards or this Agreement, against any entity or person affiliated with JTV and any of their respective directors, officers, employees, or other representatives.

The foregoing arbitration provision, limitations, and waivers shall also survive the termination of this Agreement.

Governing Law and Disputes

Your use of the JTV Gift Card and this Agreement, evidences transactions affecting interstate commerce, which render this Agreement subject to the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq. This Agreement shall otherwise be governed by and construed in accordance with the substantive laws of the State of Tennessee, without reference to any rules regarding conflicts of law; provided however, that state and federal class action rules shall not apply to any Claim between you and JTV.

Effective Date
These Terms and Conditions are effective upon publication on this website. You should not accept, purchase, redeem or otherwise use a Gift Card if you object to this Agreement.  Acceptance, purchase, redemption or use of the Gift Card constitutes acceptance of this Agreement.
